This Agreement is a legally binding contract between you ("User," "you," or "your") and Alchemical Solutions ("Company," "we," "us," or "our"). It governs your access to and use of the 9 to Zen mobile application, website, content, features, and associated services (collectively, the "Service").
Subject to your compliance with this Agreement, Alchemical Solutions grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use one copy of the 9 to Zen application on a mobile device or desktop that you own or control, solely for your personal, non-commercial use.
You explicitly agree that you will not, directly or indirectly:
You must be at least 13 years of age (or the legal minimum age in your jurisdiction) to create an account or use the Service. If you are under 18, you represent that you have reviewed this Agreement with your parent or legal guardian and that they accept these terms on your behalf.
To access certain features of 9 to Zen, you may be required to register an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
Alchemical Solutions may offer new users temporary, complimentary access to premium features of 9 to Zen (including "Ascend Level" privileges) ("Free Trial").
Any user progress, customization, or data generated during your Free Trial (such as Ascend Level metrics or saved preferences) will be retained on your account for a period of at least ninety (90) days following trial expiration. If you choose to complete a purchase during this period, your progress will be preserved seamlessly. If no purchase is made within this window, Alchemical Solutions reserves the right to archive, reset, or delete non-essential trial data in accordance with our Privacy Policy.
Alchemical Solutions reserves the right, in its sole discretion, to modify, suspend, or terminate Free Trial offers at any time without prior notice or liability.
If you decide to upgrade to a premium tier or purchase Ascend Level access following a Free Trial, you agree to pay all applicable fees, including relevant taxes, as presented at the time of purchase.
Purchases made within the 9 to Zen application are processed via authorized third-party billing providers or digital distribution platforms (e.g., Apple App Store, Google Play Store). Transactions are governed by the respective platform’s terms of service and payment policies. Alchemical Solutions does not directly collect, store, or process raw credit card information.
Because you are provided a Free Trial period to evaluate the Service prior to purchase, all post-conversion purchases are final and non-refundable, except where explicitly required by applicable law or governed by the refund policies of the App Store or Google Play Store through which the transaction was completed.
The Service, including all text, graphics, user interfaces, visual interfaces, software code, audio tracks, trademarked names (including "9 to Zen" and "Ascend Level"), logos, and overall look and feel, is the exclusive property of Alchemical Solutions or its licensors and is protected by intellectual property, trademark, and copyright laws. Except for the limited license granted under Section 2, nothing in this Agreement transfers any right, title, or interest in or to the Service to you.
Your privacy is important to us. Our collection, use, and disclosure of personal data in connection with your use of 9 to Zen and participation in Free Trials are governed by our Privacy Center document, accessible at https://alchemical-solutions.com/9-to-Zen/legal/privacy-center.html. By using the Service, you consent to our data collection practices as described therein.
You may terminate this Agreement at any time by deleting the 9 to Zen application from your device and ceasing all use of the Service.
Alchemical Solutions reserves the right to suspend or terminate your account or access to the Service, in whole or in part, without prior notice, if:
Upon termination, all licenses granted to you herein will immediately terminate, and you must cease all use of the Application and delete all copies from your devices. Sections 5, 6, 8, 9, 10, and 11 shall survive termination.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. ALCHEMICAL SOLUTIONS DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ALCHEMICAL SOLUTIONS, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.
This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which Alchemical Solutions is organized, without giving effect to any principles of conflicts of law.
Before filing a formal claim, you agree to attempt to resolve any dispute informally by contacting Alchemical Solutions at contact@alchemical-solutions.com.
If any provision of this Agreement is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
We reserve the right to modify or replace this Agreement at any time in our sole discretion. Your continued use of the Service following the posting of updated terms constitutes your acceptance of the modifications.
